Terms & Conditions
THIS CONTEST IS
INTENDED FOR VIEWING IN THE UNITED STATES ONLY, AND SHALL BE
CONSTRUED IN ACCORDANCE WITH UNITED STATES LAW (I.E., FEDERAL LAW
AND THE LAWS OF PARTICULAR STATES, AS APPLICABLE). DO NOT PROCEED IN
THIS SITE IF YOU ARE NOT A LEGAL RESIDENT PRESENTLY RESIDING IN THE
UNITED STATES.
THERE IS NO COST TO ENTER, WIN OR PARTICIPATE.
1. VOID IN ALASKA, ARIZONA, DISTRICT OF COLUMBIA, GEORGIA, HAWAII,
KANSAS, MISSISSIPPI, MISSOURI, NEVADA, NEW JERSEY, NORTH CAROLINA,
SOUTH CAROLINA, UTAH, PUERTO RICO, U.S. VIRGIN ISLANDS AND WHERE
PROHIBITED BY LAW. OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES
WHO ARE 21 YEARS OR OLDER AS OF APRIL 26, 2008 (Qualifier #1), MAY
10, 2008 (Qualifier #2) AND MAY 24, 2008 (Qualifier #3). Employees,
directors, contractors or agents of Youbet.com, their respective
parents, affiliates, subsidiaries, advertising/promotion agencies,
members of their immediate families (parents, siblings, children,
spouse) and members of the same households of such employees
(whether related or not) are not eligible to participate or win
prize(s). Only members of Youbet.com who have an account in good
standing during the course of the Contest period are eligible to
participate.

2. Players must be at least 21 years of age to participate in these
contests.
3. Players must place all wagers personally. No person shall
directly or indirectly act as an intermediary, transmitter or agent
in placing wagers for the Player, unless authorized and for good
reason shown.
4. Only one entry per person. Multiple entries are cause for
disqualification of all involved entries and decisions regarding
disqualification are made at the sole discretion of Youbet.com.
Entries generated by script, macro or other automated means are
void.
5. Contest Dates:
NHC Qualifier #1: Saturday, April 26 on racing from Cal Expo.
NHC Qualifier #2: Saturday, May 10 on racing from Cal Expo.
NHC Qualifier #3: Saturday, May 24 on racing from Cal Expo.
The contest periods begin and end on the dates stated above,
beginning with the first race at the specified track for that day
and ending after the last race is concluded at the specified track
for that day. Youbet.com reserves the right to revise contest dates
or cancel contest dates at any time prior to the start of the
contest period, due to weather conditions, scheduling changes, or
other conditions beyond the control of Youbet.com.
6. Contest Tracks and Races
Contest wagers must be placed on races from any of the following
designated contest tracks during each contest period: Cal
Expo
Each Qualifier is a separate contest that will produce one Official
First Prize winner and four consolation prize winners.
7. To Qualify:
Contest is FREE to enter.
Contest wagers are placed using real money and must be designated as
contest wagers by checking the "Enter this wager in a contest" box
on Youbet Express See example. Telephone wagers are not eligible for
contest play.
Contest play: Contestants must place a minimum $10 Win wager
("Contest Wagers") on at least six (6) different races from Cal Expo
during the designated contest period. Contestants may place as many
contest wagers as they like and for any amount above the $10 minimum
they like – all such wagers will count in the contest.
There is no cap on payouts for contest wagers. All participating
players must be a Youbet.com member to participate in any of the
contests. 60-Day Free Trial Membership available to prospects living
in states where a Youbet.com wagering account is available.
Place your wagers online with real money, following all instructions
on the Youbet.com website and/or phone menus. If you do not follow
all such instructions, your wager(s) will be ineligible for the
contests.
Wagers on horses that are scratched will not count toward meeting
the six race minimum requirement. Be sure to check for late
scratches.
Wagers placed using the Youbet Mobile telephone wagering system are
not eligible for contest play.
How to Win: The First Prize Winner shall be determined by highest
Return On Investment (ROI) among all qualifying contestants. To win
First Prize, a participant must place a qualifying contest wager on
at least 6 separate races from Cal Expo during the contest period
and finish with the highest ROI among all qualifying contestants.
ROI is calculated by summing winning wagers and subtracting from
that sum, the amount wagered (minus refunds), and then dividing that
total by the amount wagered; expressing the total as a percentage.
7. Prizes:
The qualifying contestant with the best overall ROI will be declared
the First Prize winner.
The First Prize winner shall receive:
A $500 wagering credit
A credit of up to $500 toward the purchase of R/T airfare to Newark,
NJ, to attend the NHHC Finals at The Meadowlands on June 21, 2008
Hotel accommodations for two nights (June 20 and 21).
$600 NHHC Finals admission fee
$400 NHHC Finals live bankroll
The second through fifth place ROI finishers shall receive:
2nd place: a $500 wagering credit and an official Youbet.com cap
3rd place: a $250 wagering credit and an official Youbet.com cap
4th place: a $150 wagering credit and an official Youbet.com cap
5th place: a $100 wagering credit and an official Youbet.com cap
Tie breakers:
In the event of a tie between any of the top four finishers, the
contestant who selects the most winning horses shall be awarded the
higher prize.
If a tie still remains, the contestant who selects the horse with
the highest pari-mutuel (Win) price shall be awarded the higher
prize.
If a tie still remains, the total prize money allocated to the tied
contestants shall be divided equally between the tied contestants,
with the exception of the First Prize.
If a tie for First Prize remains unbroken, Youbet.com will conduct a
separate contest, of its choosing, between the tied contestants to
determine a single First Prize winner.
There can only be one (1) First Prize winner per contest. In the
event a single member wins more than one contest, he or she shall be
awarded second prize in the second or third contest that he or she
is victorious. In such cases, the official second place finisher
shall be awarded First Prize.
First prize winners are responsible for booking round-trip air
travel to and from Newark, NJ to attend the NHHC Finals at the
Meadowlands. Youbet.com will credit up to $500 toward R/T airfare to
the First Prize winners' accounts after booking is confirmed.
Results will take a minimum of 48 hours to be audited and declared
Official. A listing of the winners will be posted on the Youbet.com
website within three business days of official track results.
8. Contest results are based only on official, final results for
races, as certified by the track steward at each contest track.
9. Youbet.com and its agencies are not responsible for incomplete,
inaccurate or incorrect capture of betting information or for
computer, telephone, cable, network, electronic or Internet hardware
or software malfunctions, failures, connections, availability or
garbled or jumbled transmissions, service provider/Internet/web
site/use net accessibility or availability, traffic congestion or
unauthorized human intervention. Youbet.com reserves the right, at
its sole discretion, to disqualify any individual it concludes, in
its sole discretion, to be tampering (or attempting to tamper) with
the betting process or the operation of the contest or web site; to
be in violation of the Official Rules and/or the Terms of Service of
the web site; or to be acting in an un-sportsman-like or disruptive
manner, or with the intent to annoy, abuse, threaten or harass any
other person. Youbet.com will prosecute any fraudulent activities to
the full extent of the law.
10. Contestants agree to abide and be bound by the Official Rules
and the decisions of Youbet.com, which are final and binding in all
respects. Winners will be notified by regular (postal) mail or
e-mail within 14 days of the end of the last contest period and will
be required to complete and return an Affidavit of Eligibility, a
Liability Release and a Publicity Release (where legal) within 14
days of receipt of prize notification. In the event of noncompliance
with this requirement, prize may be forfeited. If prize
notification/prize is returned as undeliverable, such prize will be
forfeited. Unclaimed and forfeited prizes will not be awarded. No
prize transfer. Prizes will be awarded after the conclusion of the
last contest period, within 30 days of receipt and verification of
completed Affidavit/Release. Except where prohibited by law, by
accepting prize, winner consents to the use of his/her name and/or
likeness for advertising/publicity purposes, and any and all rights
to said use, without notice or additional compensation, and further
agrees that he/she will not use the name of Youbet.com, or any logo,
trademark, slogan or other mark associated with Youbet.com, without
the express written permission of said company.
11. The Youbet.com NHHC Qualifiers are contests of skill subject to
United States law (i.e., federal law and the laws of particular
states, as applicable) and void where prohibited by law. By
participating, contestant agrees to release and hold harmless
Youbet.com and any sponsor, their parent companies, affiliates,
subsidiaries, advertising/promotion agencies, and the directors,
officers, agents, representatives, shareholders, and employees of
any of the above organizations from any and all liability associated
(directly or indirectly) with his/her participation in the contests
and/or receipt, acceptance, possession or use/misuse of any
prize(s).
12. Limitations of Liability: Youbet.com is not responsible for any
incorrect or inaccurate information, whether caused by web site
users or by any of the equipment or programming associated with or
utilized in the contests and assumes no responsibility for any
error, omission, interruption, deletion, defect, delay in operation
or transmission, communications line failure, theft or destruction
or unauthorized access to the web site. Youbet.com is not
responsible for injury or damage to any person's computer related to
or resulting from participating in the contests or downloading
materials from or use of the web site. If, for any reason, a contest
is not capable of running as planned by reason of infection by
computer virus, worms, bugs, tampering, unauthorized intervention,
fraud, technical failures, or any other causes beyond the control of
Youbet.com which, in the sole opinion of Youbet.com, could corrupt
or affect the administration, security, fairness, integrity or
proper conduct of the contest, Youbet.com reserves the right at its
sole discretion to cancel, terminate, modify or suspend the contest
and select winners in a manner, which in the sole judgment of
Youbet.com, is fair, appropriate and consistent with these Official
Rules.
IN NO EVENT WILL YOUBET.COM AND ANY SPONSOR, THEIR PARENT COMPANIES,
AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES OR THEIR RESPECTIVE
OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE
RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND,
INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE
DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE INTERNET SITE
